MASTERING FIDIC CONTRACTS IN CONSTRUCTION
INTRODUCTION
FIDIC contracts are being increasingly used by the international Construction Industry throughout the World. The Multi-Lateral Development Banks, including the World Bank, Inter -American Development Bank & Caribbean Development Bank have adopted the FIDIC Conditions of Contract.
The interactive course is based on the FIDIC Module 1 Workshop and introduces the FIDIC Suite of Contracts, with special emphasis on the FIDIC Red and Yellow Book (1999).
It examines the roles of both the Employer and the Contractor and highlights the essential differences between the various contract documents. The responsibility for design is dealt with and a substantial amount of time is devoted to the issue of extensions of time, variations and certification.
Dispute resolution under the FIDIC Contracts is Emphasized and the issues of notices, claims and time bars are discussed. This practical course is supplemented by group discussions to ensure that delegates come away with a good understanding of the FIDIC philosophy.
Delegates will be provided with a sound understanding on the practical use of the FIDIC Suite of Contract with special emphasis on Construction (Red Book) & Design-Build (Yellow Book) Contracts. The procedures and application of the Contract clauses are explored and quizzes are utilized throughout the training. Delegates will be much more confident in using these complex Contracts after completing the course.
AIMS AND OBJECTIVES
Delegates will learn how to choose the appropriate for of contract for your project and you will learn about the rights and obligations of the parties to the contract.
We will examine the roles and responsibilities of both the Employer and the Engineer and will highlight the differences between the various contract documents.
The responsibility for design will be dealt with and the issue of extension of time, variations and certification will be discussed.
In addition, the delegates will be introduced to the issues of notices, claims and time bars with in-depth analysis.
*A Certificate of Completion will be awarded to students upon the successful completion of all teaching sessions
LEARNING OUTCOMES
By the end of the program, participants will be able to:
- Apply the correct FIDIC form of contract that is best suited for each project.
- Implement FIDIC’s principles, mechanisms, and best practices for contract and project management.
- Demonstrate the responsibilities, obligations, and entitlements of the Employer and the Contractor.
- List the engineer’s different roles, duties, and responsibilities in relation to FIDIC contracts.
- Apply the correct payments, claims, and dispute resolution mechanisms as envisaged by the FIDIC contracts.
